PROCEDURE FOR BUYING PROPERTY IN TURKEY FOR FOREIGNERS

When you have decided to buy a property in Turkey, below is the steps to be followed:

Signing sales contract and payment

When you decide  to purchase a property,  we prepare you a sales contract.. Name of the buyer(s), seller, our agent, specifications of the property and conditions will be included in the sales contract.

When signing the sales contract, you will be asked to pay a down payment amount of which can differ depending on the owner. However, you can expect a down payment between € 2.000 – 10.000. Name of the buyer(s), seller, our agent, specifications of the property and conditions will be included in the sales contract.

After this point, we check the property again and make sure that property is free from any encumbrances. This is an official form that is signed and stamped by local Land Registry Office.   

Within 10 business days, you will have to send the first agreed payment written in the sales contract. There can be different payment schedules depending on the property and its owner (usually, for off plan or uncompleted properties, you can expect payments in instalments. For ready-to-move-in properties, you will be usually asked to pay a higher amount of deposit, and then pay the remaining balance just before signing the title deed)

You might need to open a bank account in Turkey. Any person can open a bank account in Turkey. You only need an address document from your country. An utility bill (electricity, water, internet, broadcasting bills, etc.) where your name and your house address written on the bill is obligatory.

Legal procedure regarding property purchase

Although foreigners have same rights on their properties as Turkish criticizes once they have Title Deed (: Tapu) issued, there is a difference in legal process: Foreigners must get a permission from the Military Headquarters, if the property is "not" within the military zones. This permission application and approval process takes approximately 1 month. Almost in all the cases, applications are approved, simply because local governments do not give permission to build anything within military zones.

To carry out the procedure on your behalf, either you can hire a local lawyer or we can do it without extra service fee. The following will be needed to complete the procedure:

  • Translation of your passport by sworn translator and notary approval
  • Power of attorney- either to us or a lawyer ( to buy property and get title deed issued on your name)
  • 6 passport photos
  • Turkish tax number ( necessary to have title deed issued on your name. We will assist you on this)

Sum of legal procedure costs depends on the property, but excluding lawyer fee (if hired by you) is approximately %4 of the sales price, assuming that title deed will be issued from minimum declaration value determined by local municipality. If title deed is issued from sales price, legal fees will increase paralleling the declared value. Legal procedure costs include the following:

  • Title deed application fees
  • Notary public expenses
  • Sworn interpreter fee
  • Property sales tax ( 4% of declared value )
  • Habitation fee
  • Electric and water registration / subscription fee
  • Lawyer fee (if you wish to hire)

Once application is approved by Military Headquarter, related taxes are paid, then the seller and the buyer ( or holder of power of attorney on granted by buyer) sign conveyance act at Title Deed and Land Registry Office. All payment for the purchased property should be done prior to signing of the conveyance act. According to property law, the seller has to declare "I have been paid fully".

Once title deed is issued on your name, you are the legal owner of the property including its share on the land it is situated (shown on the title deed document).

To complete all process regarding your property:

  • Habitation fee should be paid
  • Electric and water subscriptions should be registered or transferred on your name by holder of power of attorney on behalf of buyer.
